Default digiweb help needed.

Hi all, I accepted an offer from digiweb to upgrade from metro lite to metro in june.This offer came via email and i repiled to the email to be upgraded.

It was free for two months so i would pay no extra.

Since then I have decided i have had enough of digiweb because of thier 30gb traffic limit.When i recieved an invoice from them for €300 for the next 12 months i decided to leave them.

I phoned thier sales line but was informed that i had agreed to a further 12 month contract when i upgraded.They said this was explained to me at the time but it was not, i'm sure about that.

I rechecked the email and there is no mention of a further 12 month contract.
I checked thier t&c on the website and it states that i can cancel by giving a month's notice in writing but the sales man tells me i am locked into this contract.
Plus i dont have enough money in my account to pay thier 12 month invoice and thier t&c states they charge €20 for a default fee plus 15% interest on the balance.

does anyone know if i can complain to an ombudsman or similar?

can i get out of this contract or am i stuck?

advise needed please.

Hi

You don't say how long that you are with them. However if you are over the twelve month initial period for Metro Lite you can cancel at any point by giving a months notice in writing as per their terms & conditions. Also if you are paying by direct debit you can instruct your bank (in writing) to cancel the direct debit payment to Digiweb, but you must also notify them too (also in writing) that you are doing so. But do it fast before they request the payment from the bank.

As nothing has been signed by you in theory the company cannot sue you, as an unsigned contract does not hold much in court. If unsure seek legal advice.

Also call the NCA (National Consumer Agency) and see what advice they may give.

thanks cunnijo, I contacted them via email and they phoned me today.

as I am outside the 12 month period i was able to cancel the contract.the salesman was full of it.

well worth standing up to these people.

Hi

Good for you. Your posting is a warning to other clients to be beware of when it comes to their renewal date. I would still however contact the bank to cancel the direct debit to them before an attempt is made from the company to get payment.

As a matter of interest what company will be supplying you with broadband from this on? Hopefully they will be a lot better than the last one.

i will be transfering to irish broadband. a friend has been using them for 2 years and thinks they are great. my two eldest children will be getting laptops for xmas so i will need the unlimited downloads that ibb offer.

Hi, just a quick update. I was cut off by digiweb on the monday...even though i had paid till the friday. cheek.

then they deducted €415 from my bank account.I contacted the bank and they explained that as I was a good customer and my wages were going in at the end of the month they allowed digiweb to take the money.
I pointed out that I am unable to take money from my account when its empty so a company doing it is unfair.

contacted digiweb and asked for refund,they told me it would take a month.after some pushing and pointing out that they STOLE the money from my account they agreed to send a refund next week on friday.the cheuqe will take a week to clear so I am without that money for a total of 3 weeks.

not a happy guy at the mo.

Hi

Did you cancel the direct debit with the bank before DW claimed the €415? If you did then your bank are at fault for paying them and it is up to them to repay you. Whatever you do, do not let DW away with it. If the refund is not with you within at most 2 weeks follow it up.

Has IBB connected you? If they have what is the quality of service like? Hopefully it is better than DW and hopefully you will not be disappointed.

yep,ibb have connected me,service is brillant at the moment.if it gets worse then i will post about it

am back again,i have finally recieved my refund from digiweb. it only took from 23rd aug up untill today,27th september.
now i gotta wait a week for the check to clear.

thank goodness ibb is serving me well.
